There is no patent system from my point of view. Author's rights are the legal framework for software. Nothing else.

How to proceed with Patent Holder (or their lawyer) when they are harassing you ?

Not playing their game. Game rules are incorrects
Inform public that the patent harasser is not playing fair
Don't be afraid. A lot are just bluffing in order to stop you.
